What is management liability insurance?

Management liability insurance is a package policy designed for the risks of managing a business. It typically combines several sections – such as directors & officers liability, company reimbursement, employment practices liability, statutory liability, crime and tax audit – so the company and the people running it are protected under one policy. Who needs management liability insurance?

It is commonly bought by private companies, family businesses, not-for-profits and associations. If your organisation has directors or a committee, employs staff, handles money or must comply with workplace, safety, environmental or tax laws, it's worth talking to us about your exposure.

Isn't public liability insurance enough?

Public liability is designed for injury to people and damage to property caused by your business. It generally doesn't respond to things like an employee's unfair dismissal claim, a regulator's investigation, a tax audit, employee theft or a claim against a director over a business decision. Management liability is built to fill those gaps, so the two policies usually work side by side.

What's the difference between management liability and D&O insurance?

Directors & officers (D&O) insurance focuses on the personal liability of directors and officers. Management liability usually includes D&O as one section, then adds cover for the company itself, such as employment practices, statutory liability, crime and tax audit. Larger or listed companies often buy standalone D&O, while many private companies and not-for-profits choose a management liability package.

Does management liability cover fines and penalties?

Some policies can cover certain fines and penalties under the statutory liability section, but only where the law allows them to be insured. Many penalties – particularly some under work health and safety laws – cannot legally be insured. Defence and investigation costs are more commonly covered. Does it cover employee theft?

Many management liability policies include a crime or fidelity section that can cover financial loss from theft or fraud by employees. Some policies also extend to certain types of third-party fraud. Cover, conditions and sub-limits vary between insurers, so check the wording or ask us to compare.

Generally, yes. Most management liability policies respond to claims first made against you and notified to the insurer during the period of insurance. That's why it's important to keep cover continuous and to tell us promptly about any claim or circumstance that might lead to one.
